WV Poster Changes

Minimum Wage Update: The West Virginia Minimum Wage poster has been updated to reflect an increase to the state's minimum wage, according to House Bill 4283. The minimum wage rate will increase from $7.25 an hour to $8.00 an hour effective January 1, 2015, and $8.75 an hour effective on January 1, 2016. Increases to the training wage for the first 90 days of employment and minimum wage credits for tipped employees will also increase for 2015 and 2016. Effective Date: January 1, 2015

Wage Payment and Collection Act: West Virginia made numerous minor changes to their Wage Payment and Collection Act notice. Among these was the substantive change of the amount of time that an employer has to pay wages and benefits to discharged employees after discharge (formerly 72 hours, now, up to 4 business days). Effective date: July 2013

The Family and Medical Leave Act notice has been revised to reflect the changes caused by the recently approved rule. The definition of "Veteran" has been revised to include both those who serve and those discharged in the past 5 years (previously it was only those who served). The explicit definition of "Serious Injury or Illness" was removed as well, replaced by a notice that there are differences between the definition of "Serious Injury or Illness" for a service member or veteran, and "Serious Health Condition" under the FMLA. Effective Date: March 8, 2013
