DE Poster Changes

The minimum wage increased from $7.25 to $7.75 effective 6/1/2014. The minimum wage increased again 6/1/2015 to $8.25.

Discrimination: Delaware has added pregnancy accommodations to the Discrimination notice. In addition to the posting requirement, employers will also be required to notify, in writing, existing employees, new hires and pregnant employees (the latter within 10 days of notification of the pregnancy). Effective Date: October 2014

Whistleblower Protection: The Delaware Department of Labor has released an updated Whistleblower Protection poster that includes information regarding retaliation against an employee for reporting or participating in an investigation of campaign finance violations. Effective Date: 10/22/14

Fair Employment: The Delaware Department of Labor has released an updated Fair Employment poster that must be displayed by employers. This mandatory update reflects that employers are now prohibited from discriminating against employees based on gender identity. Effective Date: 10/22/14

The Family and Medical Leave Act notice has been revised to reflect the changes caused by the recently approved rule. The definition of "Veteran" has been revised to include both those who serve and those discharged in the past 5 years (previously it was only those who served). The explicit definition of "Serious Injury or Illness" was removed as well, replaced by a notice that there are differences between the definition of "Serious Injury or Illness" for a service member or veteran, and "Serious Health Condition" under the FMLA. Effective Date: March 8, 2013
