Minimum Wage
The California Minimum Wage poster has been updated to reflect an increase in the state minimum wage. The California Department of Industrial Relations has increased the minimum wage from $10.00 per hour to $10.50 per hour for employers with 26 or more employees, effective January 1, 2017. Employers with 25 or fewer employees will remain at $10.00 per hour.
Effective Date: January 1, 2017


Mandatory Federal Poster Update!

FLSA and EPPA

The Fair Labor Standards Act (FLSA), aka Minimum Wage, notice has been revised based on upcoming changes to the rules. Among other minor revisions are three major revisions. First, the new notice advises that nursing mothers who are subject to the overtime requirements of the FLSA be provided reasonable break time to express breast milk and a place to do so, other than a bathroom, which is shielded from view and free from intrusion by coworkers or the public. Second, the enforcement provisions have been significantly revised explaining additional penalties for violations of the law. Third, the new notice addresses the misclassification of workers as "independent contractors" when they should be considered employees under the law.

The Employee Polygraph Protection Act (EPPA) notice has also been revised. There is a new QR Code and other cosmetic changes. Despite the lack of significance of these changes, the Department is deeming it a mandatory update.

This is a substantive change and an updated Federal V2.0 poster is required.

Effective date: July 2016

Pregnancy Disability/CFRA Leave
The California Pregnancy Disability/CFRA Leave poster has been updated to include information on employees providing advance notice for foreseeable events such as the expected birth of a child or a planned medical treatment. In addition, a new section explains additional rights under the California Family Rights Act (CFRA).
Effective Date: February 28, 2016

Workers' Compensation
California has released the new Workers' Compensation notice. This substantially revises the sections addressing the physicians that can treat an employee injured on the job, as well as who can be contacted for assistance with locating a physician or filing a claim. Version 5.0 projected availability: The week of January 11th. This is a substantive change and an updated California All-In-One poster is required.
Effective Date: January 2016 

Workers' Compensation - Santa Clara
The minimum wage was increased to $11.00 per hour on January 1st, 2016. The notice must be posted in the top three languages spoken in the city (English, Spanish, Vietnamese). This is a substantive change and a new Santa Clara poster is required.
Effective Date: January 2016 

Minimum Wage - Palo Alto
The city of Palo Alto has released their new minimum wage notice. The new wage will be $11.00 as of January 1st, 2016. The notice must be posted in English and any language spoken by 5% of the employees. The notice must also be given to the employees. This is a substantive change and a new Palo Alto poster is required. 
Effective Date: January 2016

Substantive Change for Paid Sick Leave in California
The state has released the new template notice for the Paid Sick Leave law that was passed this past summer. Though employees do not begin to accrue Paid Sick Leave until July of 2015, the posting requirement and the law itself do go into effect January 1st. This is a completely new notice.
