Minimum Wage
The Colorado Minimum Wage poster has been updated to reflect an increase in the minimum wage rate. Effective January 1, 2017, the minimum wage rate increased from $8.31 an hour to $9.30 an hour for non-tipped employees and from $5.29 an hour to $6.28 an hour for tipped employees.
Effective Date: January 1, 2017

Mandatory Federal Poster Update!


The Fair Labor Standards Act (FLSA), aka Minimum Wage, notice has been revised based on upcoming changes to the rules. Among other minor revisions are three major revisions. First, the new notice advises that nursing mothers who are subject to the overtime requirements of the FLSA be provided reasonable break time to express breast milk and a place to do so, other than a bathroom, which is shielded from view and free from intrusion by coworkers or the public. Second, the enforcement provisions have been significantly revised explaining additional penalties for violations of the law. Third, the new notice addresses the misclassification of workers as "independent contractors" when they should be considered employees under the law.

The Employee Polygraph Protection Act (EPPA) notice has also been revised. There is a new QR Code and other cosmetic changes. Despite the lack of significance of these changes, the Department is deeming it a mandatory update.

This is a substantive change and an updated Federal V2.0 poster is required.

Mandatory State Updates:

Colorado Anti-Discrimination 
The Colorado Civil Rights Division has updated their Anti-Discrimination Notice. "Pregnancy" is listed as a new protected class under the Employment Discrimination section of the notice. Aubrey Elenis is the new Colorado Civil Rights Division Director and the new revision date for the notice is 8/5/2016.
Effective Date: August, 2016

Pregnancy Accommodations
The Colorado Civil Rights Division has released a new Pregnancy Accommodations notice. According to the Colorado Pregnant Workers Fairness Act, it is considered a discriminatory or unfair employment practice if an employer fails to provide reasonable accommodations to an applicant or employee who is pregnant, physically recovering from childbirth, or a related condition. The Act also prohibits an employer from taking adverse action against an employee who requests or uses a reasonable accommodation and from denying employment opportunities to an applicant or employee based on the need to make a reasonable accommodation. Additionally, the notice lists a scope of requirements for reasonable accommodations. Lastly, all employers must post a written notice in a conspicuous area of the workplace and must also provide this notice to new employees at the start of employment and to current employees within 120 days of the Act's August 10, 2016 effective date.

Fair Employment
The Colorado Fair Employment poster has been updated to reflect a new protected category under the Colorado Anti-Discrimination Act (CADA). A new law makes it an unfair labor practice for an employer to fail to provide a reasonable accommodation to a job applicant or an employee with health conditions related to pregnancy or physical recovery from childbirth, absent an undue hardship on the employer.
