Minimum Wage Update:
The Massachusetts Minimum Wage increased to $11.00 and to $3.75 for tipped employees. The minimum wage rates (per hour) became effective on January 1, 2017. The poster has been updated to reflect the addition of the Massachusetts Paid Leave Law. The law requires employers with 11 or more employees to provide paid sick leave. The poster was also updated with information regarding pay and deductions, the rights of domestic workers and temporary workers domestic violence law.
Effective Date: January 2017


Mandatory Federal Poster Update!

FLSA and EPPA

The Fair Labor Standards Act (FLSA), aka Minimum Wage, notice has been revised based on upcoming changes to the rules. Among other minor revisions are three major revisions. First, the new notice advises that nursing mothers who are subject to the overtime requirements of the FLSA be provided reasonable break time to express breast milk and a place to do so, other than a bathroom, which is shielded from view and free from intrusion by coworkers or the public. Second, the enforcement provisions have been significantly revised explaining additional penalties for violations of the law. Third, the new notice addresses the misclassification of workers as "independent contractors" when they should be considered employees under the law.

The Employee Polygraph Protection Act (EPPA) notice has also been revised. There is a new QR Code and other cosmetic changes. Despite the lack of significance of these changes, the Department is deeming it a mandatory update.

This is a substantive change and an updated Federal V2.0 poster is required.

Minimum Wage Update
The Massachusetts Minimum Wage poster has been updated to reflect an increase in the minimum wage rate. Effective January 1, 2015, the minimum wage rate will increase from $8.00 an hour to $9.00 an hour for non-tipped employees and from $2.63 an hour to $3.00 an hour for tipped employees.
Effective Date: January, 2015

Unemployment Insurance
Massachusetts has revised their UI notice. Along with some formatting changes and the deletion of information regarding the use of a Social Security number for filing claims online, they have added the specification that claimants for UI must be in the United States, its territories, or Canada to claim or certify for UI benefits. This is a substantive change and an updated Massachusetts poster is required.
Effective Date: October, 2015

Fair Employment Update
The Massachusetts Fair Employment poster has been updated with information on the Domestic Workers Bill of Rights. The law prohibits discrimination and harassment against certain domestic workers. The poster was also updated with other changes regarding parental and disability leave.
Effective Date: June, 2015

Earned Sick Time Update
The Massachusetts Earned Sick Time poster has been released by the Massachusetts Attorney General's Office. Under the new law, workers will get one paid hour of sick leave for every 30 hours worked, with a maximum of 40 hours of sick leave per year. Employers are required to post a notice informing employees of their rights.
Effective Date: June, 2015

Maternity and Parental Leave Update
The Massachusetts Maternity and Parental Leave poster has been updated to reflect that maternity and parental leave is applicable to both men and women. Employers will now be required to provide leave to both men and women and provide job protection to workers during the birth or adoption of a child.
