Minimum Wage Update
Maryland has released their new notice reflecting the changes to the minimum wage through 2018. The wages are as follows:  

  • Effective Date: 1/1/15-$8.00 
  • Effective Date: 7/1/15-$8.25 
  • Effective Date: 7/1/16-$8.75 
  • Effective Date: 7/1/17-$9.25 
  • Effective Date: 7/1/18-$10.10 

Mandatory Federal Poster Update!

The Fair Labor Standards Act (FLSA), aka Minimum Wage, notice has been revised based on upcoming changes to the rules. Among other minor revisions are three major revisions. First, the new notice advises that nursing mothers who are subject to the overtime requirements of the FLSA be provided reasonable break time to express breast milk and a place to do so, other than a bathroom, which is shielded from view and free from intrusion by coworkers or the public. Second, the enforcement provisions have been significantly revised explaining additional penalties for violations of the law. Third, the new notice addresses the misclassification of workers as "independent contractors" when they should be considered employees under the law.

The Employee Polygraph Protection Act (EPPA) notice has also been revised. There is a new QR Code and other cosmetic changes. Despite the lack of significance of these changes, the Department is deeming it a mandatory update.

This is a substantive change and an updated Federal V2.0 poster is required.

The Maryland Child Labor poster has been updated to reflect additional information with respect to special permits. The Maryland Department of Labor has added an online address for applications and permits from the Baltimore Office of the Maryland Department of Labor.

Equal Pay for Equal Work
The Maryland Equal Pay for Equal Work poster has been updated to reflect an amendment to the Maryland Equal Pay for Equal Work law. The amended law gives more workers protection from wage discrimination, prohibiting pay discrimination on the basis of sex or gender identification. The new law also makes it easier for employees to discover and discuss disparities in pay.

Equal Pay for Equal Work - NEW POSTER
The Maryland Equal Pay for Equal Work poster has been updated to reflect enforcement information should the Commissioner of Labor determine a violation. Specifically, the 3-306.1. Enforcement includes: 

  • Whenever the Commissioner determines that this subtitle has been violated, the Commissioner shall: 
    • Try to resolve any issue involved in the violation informally by mediation; or 
    • Ask the Attorney General to bring an action on behalf of the applicant or employee. 
  • The Attorney General may bring an action under this section in the county where the violation allegedly occurred for injunctive relief, damages, or other relief.
  • This is a material substantive change and a new, Maryland All–In-One poster will be required.
  • Effective Date: April 21, 2015
