Minimum Wage, Daily Overtime, and Pregnancy Fairness

Even though only the date had changed, the state of Nevada has verified that the Minimum Wage and Daily Overtime notices are substantive changes.

The Pregnant Workers' Fairness Act has been added to the state poster. Even though it doesn't go into effect until October 1st, the state requires it to be posted now.

Nursing Mothers. The new ordinance requires employers to allow reasonable break time and a clean location for breast milk expression and prohibits retaliation for this allowance.

Because of the following exceptions, we are providing this notice as a standalone poster in anticipation of another change coming due Jan 1, 2018. Our All-In-One poster will be updated with both notices closer to that date.

  • If an employer compliance will cause undue hardship considering size, financial resources, nature and structure of the business, the employer and employee may agree upon a reasonable alternative.
  • Employers with less than 50 employees are not subject to the requirements if they would impose undue hardships as noted above.
  • Contractors licensed pursuant to chapter 624 of NRS is not subject to the requirements with regard to an employee who is performing work at a construction jobsite that is located at least 3 miles from the regular place of business of the employer.

The Nevada Annual Minimum Wage Bulletin was updated to reflect the minimum wage rates effective July 1, 2015. The rates will remain unchanged on July 1, 2017.

The Nevada 2015 Annual Daily Overtime Bulletin was updated to reflect the overtime rates effective July 1, 2015. The rates will remain unchanged on July 1, 2017.

Mandatory Federal Poster Update!

The Fair Labor Standards Act (FLSA), aka Minimum Wage, notice has been revised based on upcoming changes to the rules. Among other minor revisions are three major revisions. First, the new notice advises that nursing mothers who are subject to the overtime requirements of the FLSA be provided reasonable break time to express breast milk and a place to do so, other than a bathroom, which is shielded from view and free from intrusion by coworkers or the public. Second, the enforcement provisions have been significantly revised explaining additional penalties for violations of the law. Third, the new notice addresses the misclassification of workers as "independent contractors" when they should be considered employees under the law.

The Employee Polygraph Protection Act (EPPA) notice has also been revised. There is a new QR Code and other cosmetic changes. Despite the lack of significance of these changes, the Department is deeming it a mandatory update.

This is a substantive change and an updated Federal V2.0 poster is required.
