Mandatory Federal Poster Update!

FLSA and EPPA
The Fair Labor Standards Act (FLSA), aka Minimum Wage, notice has been revised based on upcoming changes to the rules. Among other minor revisions are three major revisions. First, the new notice advises that nursing mothers who are subject to the overtime requirements of the FLSA be provided reasonable break time to express breast milk and a place to do so, other than a bathroom, which is shielded from view and free from intrusion by coworkers or the public. Second, the enforcement provisions have been significantly revised explaining additional penalties for violations of the law. Third, the new notice addresses the misclassification of workers as "independent contractors" when they should be considered employees under the law.

The Employee Polygraph Protection Act (EPPA) notice has also been revised. There is a new QR Code and other cosmetic changes. Despite the lack of significance of these changes, the Department is deeming it a mandatory update.

This is a substantive change and an updated Federal V2.0 poster is required.

Effective date: July 2016

Other recent Oregon State poster changes impacting your operations...

OSHA
The Oregon OSHA poster has been updated to reflect the federal OSHA rule requiring employers to inform employees of their right to report work-related injuries and illnesses free from retaliation.
Effective Date: October 13, 2016

Minimum Wage
Oregon has passed a law to increase the minimum wage annually through 2023 beginning July 1st. The new notice has not yet been released but, once it has, we will update our state poster.
This is a substantive change and an updated Oregon poster is required.
Effective Date: July 2016

Sick Time
Oregon has released their Sick Time law notice. Employers are required to provide employees with a notice of the law's provisions. While this notice is not required to be posted, it must at least be given to employees, included in an Employee Handbook, etc..
Effective Date: January 2016

Minimum Wage
Oregon has released their 2016 Minimum Wage notice. While the wage remains the same, the new notice includes new information regarding domestic workers (house cleaners, etc.). The Bureau of Labor and Industries would not confirm whether the update is required of all employers. The Wage and Hour Administrator says employers "probably should" update their poster but "probably" won't assess a penalty for not doing so unless the the business employs domestic workers. As such, we recommend an update for compliance, though only domestic worker employers should consider this update required as a substantive change. This is a substantive change and an updated Oregon poster is required.
Effective Date: January 2016
