The Virginia OSHA poster has been updated to reflect the federal OSHA rule requiring employers to inform employees of their right to report work-related injuries and illnesses free from retaliation.
Effective Date: April 24, 2017

The Virginia Earned Income Tax Credit poster has been updated to reflect the federal 2016 EITC income limits.
Effective Date: February 10, 2017

Mandatory Federal Poster Update

The Fair Labor Standards Act (FLSA), aka Minimum Wage, notice has been revised based on upcoming changes to the rules. Among other minor revisions are three major revisions. First, the new notice advises that nursing mothers who are subject to the overtime requirements of the FLSA be provided reasonable break time to express breast milk and a place to do so, other than a bathroom, which is shielded from view and free from intrusion by coworkers or the public. Second, the enforcement provisions have been significantly revised explaining additional penalties for violations of the law. Third, the new notice addresses the misclassification of workers as "independent contractors" when they should be considered employees under the law.

The Employee Polygraph Protection Act (EPPA) notice has also been revised. There is a new QR Code and other cosmetic changes. Despite the lack of significance of these changes, the Department is deeming it a mandatory update.

This is a substantive change and an updated Federal V2.0 poster is required.

The new notice, based on recently enacted legislation, notes the requirement to report all "injuries or illnesses that result in an in-patient hospitalization, amputation, or loss of an eye" within 24 hours. Previously, these were listed as requiring reporting within 8 hours, whereas now only fatalities must be reported within 8 hours. This is a substantive change and an updated Virginia poster is required.

Unemployment Insurance
The Virginia Unemployment Insurance poster has been updated to reflect a web address change when filing online. The website for making online claims was changed to Those who are totally unemployed must also first register for work at before applying for benefits. (Among the changes made to the Unemployment Insurance poster are the combining of the “totally unemployed” and “reduced hours” sections into one section.) This is a substantive change and a new, Virginia All–In-One poster is required.
